1. Agreement
By using the hosted Maxwell service (the public Discord bot, maxwell.z3ki.dev, generated sites on that origin, or related APIs), you accept these Terms and the Privacy Policy. If you do not agree, do not use the hosted service.
2. Open source vs this host
Maxwell the software is open source under the MIT License. You may run, modify, and self-host it under that license, for free.
These Terms cover this operator's hosted instance only — the public bot and site the operator actually runs. Self-hosting is not billed, not limited by these Terms, and not supported as a paid product.
3. Public Alpha, no SLA
The hosted instance is in Public Alpha. Features, models, and usage limits may change. Tools may fail and data may be lost during development. There is no uptime guarantee. Keep your own copies of important files and information.
4. Eligibility
You must be allowed to use Discord (typically 13 or older) and you must follow Discord's Terms of Service and Community Guidelines. Do not use the hosted bot if you cannot legally agree to contracts in your jurisdiction.
5. What the service does
Maxwell is an official Discord bot with chat, memory, and tools. Depending on configuration it may read messages directed at it, remember things, search the web, generate images, publish static sites, run sandboxed shell jobs, and process supported attachments. Maxwell does not join voice channels or listen to calls. AI output is often wrong. You are responsible for what you do with it.
Reply visibility. /maxwell replies are public by default. You can choose Private for one request or save it in /config. Public replies are visible to people with access to that channel. Private replies are visible only to the requester in Discord, but are still processed by Maxwell and its configured providers.
6. Usage limits and possible paid access
During Public Alpha the hosted instance is free and may enforce temporary usage limits. Limits and reset windows may change as needed to manage capacity, reliability, or abuse; today's allowance is not guaranteed to remain unchanged. When available, the usage meter shows a percentage against the currently configured allowance and reset information for the current window. It is a snapshot of current usage, not a promise that the same allowance or reset window will remain in effect.
Maxwell Plus is not currently for sale, and billing is not enabled. Any future paid plan's price, usage allowance, reset rules, and other material subscription terms will be shown before purchase. Current proposals are not an offer or a price commitment. The MIT source stays free to self-host.
Unless the law says otherwise, experimental/free use is provided without refunds. If paid access launches, applicable refund terms will be shown before purchase.
7. Acceptable use
You may not use the hosted service to:
- break the law, Discord's rules, or someone else's rights
- attack, probe, or overload this host, other users, or third-party APIs
- try to extract secrets, tokens, or other users' private data
- publish malware, CSAM, or content the operator reasonably refuses to host
- impersonate the operator or claim Maxwell is a finished, guaranteed product
The operator may refuse requests, restrict usage, or suspend users and servers to protect the service, enforce these terms, or respond to abuse.
8. Your content
You keep whatever rights you already have in what you send. You grant the operator a license to store, process, embed, and transmit that content as needed to run Maxwell — including sending prompts and files to third-party model providers, keeping memory, and publishing sites you ask it to generate. Generated sites you publish on the public origin are public.
Do not send content you are not allowed to share. Maxwell may retain logs and memory; see the Privacy Policy.
9. AI output
AI output can be inaccurate, biased, or invented. It does not represent professional advice or the operator’s personal views. Verify important information before acting on it.
10. Third parties
The hosted bot sits on Discord and talks to AI, image, search, and media-processing providers the operator configures. Their terms apply too. Outages or policy blocks on those providers are not the operator's breach.
11. No warranty
THE HOSTED SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. No uptime or accuracy guarantee is made for the public alpha.
12. Limitation of liability
To the maximum extent allowed by law, the operator is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, lost profits, or replacement compute. If there is any liability at all, it is capped at the greater of (a) the amount you paid the operator for the hosted service in the previous three months or (b) US$30. During free Public Alpha that amount is likely zero, so the cap is US$30.
Some places do not allow these limits. In those places, the limits apply to the fullest extent permitted.
13. Termination
You can stop using the hosted service at any time. The operator can suspend or delete access, memory, and generated sites at any time, especially during Public Alpha. Surviving sections: 8–12, 14–15.
14. Changes
These Terms can change. The version on this page is the current one. Changes are posted here. Continued use of the hosted service after a change means you accept the updated Terms.
